Terms & Conditions

I, the CLIENT, give permission for the PHOTOGRAPHER(S) and / or VIDEOGRAPHER(S) to capture footage of the people scheduled for the photoshoot. I understand that I have hired BP Collaborative for their professional and artistic abilities. I understand that the PHOTOGRAPHER(S) and / or VIDEOGRAPHER(S) are not liable if anyone becomes injured during the photoshoot or session. Any damage to BP Collaborative property will be covered in full, or a replacement will be paid for by the hiring party if the damage is not at the fault of the PHOTOGRAPHER(S) and/or VIDEOGRAPHER(S).

Should I cancel in less than 24 hours before a valued session of $600 or under, I will be charged a $50 cancellation fee. For sessions $600+ that are canceled in less than 10 days, I understand that I am subject to a 20% cancellation fee. Otherwise, my deposit or payment will be returned in full if enough notice has been given and acknowledged by BP Collaborative. If I am late for a session, I acknowledge that I am subject to a $20 fee per 30 minutes that I am late. I understand that if I extend the time of hire for the PHOTOGRAPHER(S) and / or VIDEOGRAPHER(S) that I will be financially responsible for additional hours and product charges. The CLIENT agrees to:

(1) obtain permits and/or necessary permission for all locations at which BP Collaborative will be providing services; and (2) provide relevant information to assist the company with the performance of the services.

For EVENT HIRE:

(1) The CLIENT shall confirm the schedule of activities at the Event at least one week before the Event.

(2) BP Collaborative is limited by the rules and guidelines of the location and site management at the event. Negotiation with the officials for moderation of any guidelines is the CLIENT's responsibility; the PHOTOGRAPHER(s) or VIDEOGRAPHER(s) may offer technical recommendations but are not responsible for negotiation.

(3) BP Collaborative will endeavor to produce and deliver media of the Event, but is not responsible for requested media not shot or missed, lack of coverage resulting from weather conditions, behavior of subjects, lack of available light, location restrictions, other videos, photographers, or flashes, or other conditions beyond the control of the the PHOTOGRAPHER or VIDEOGRAPHER.

BP Collaborative grants CLIENTS a non-exclusive perpetual personal-use license to download and copy the accompanying image(s) or video(s) (collectively, "Media,") subject to the following restrictions: This license is for personal use only. Personal use means non-commercial use of the Media for display on personal websites and computers, or making image prints or video copies for personal use. Images MAY NOT be altered in any way since they reflect the art of BP Collaborative. The Media may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The Media may not be used in advertising. The Media may not be resold, relicensed, or sub-licensed. Title and ownership, and all rights now and in the future, of and for the Media remain exclusively with the Content Provider. There are no warranties, express or implied. The Media are provided 'as is.'

BP Collaborative grants COMMERCIAL CLIENTS a perpetual, non-exclusive, non-transferable, worldwide license to use the accompanying image(s) or video(s) (collectively, "Media,") for permitted commercial purposes, defined as: advertising, social media, promotion, brochures, packaging, as part of a commercial website for promotional purposes use prints, posters, flyers, tearsheets for promotional purposes (not for resale), prints, posters, or other commercial display of Media (4000 x 6000 pixels max), magazines, books, newspapers, other printed publications, video, broadcast, theatrical. What you may not do: CLIENT may not resell, relicense, redistribute without express written permission from Bozanich Photography. Use as a derivative work, and reselling or redistributing such derivative work is prohibited. Media may not be used in a pornographic, obscene, illegal, immoral, libelous or defamatory manner. Media may not be incorporated into trademarks, logos, or service marks. Media may not be made available for download. BP Collaborative retains all rights, licenses, copyright, title and ownership of the Media. There is no warranty, express or implied, with the purchase of this digital image or video file. BP Collaborative will not be liable for any claims, or incidental, consequential or other damages arising out of this license or CLIENT'S use of the Media.

This agreement contains the entire understanding between BP COLLABORATIVE and the CLIENT. It supersedes all prior and simultaneous agreements between parties. The only way to add or change this agreement is to do so in writing, signed by all parties. If the parties want to waive one provision of this agreement, that does not mean that any other provision is also waived. The party against whom a waiver is sought to be effective must have signed a waiver in writing. The CLIENT under this agreement shall be responsible for reasonable attorney’s fees and costs of collection of any unpaid and overdue amounts payable to Bozanich Photography.

By providing a telephone number and submitting the contact form you are consenting to be contacted by SMS text message, phone calls or email which may be recorded unless you opt-out from such communications. You may reply Help for more information. By submitting, you understand that your consent to be contacted is not a requirement to purchase any product or service and that you can opt out at any time. No mobile information will be shared/sell with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
